Is forex trading legal in South Africa?
The rule
Retail forex/CFD trading is legal and regulated in South Africa. The conduct regulator is the Financial Sector Conduct Authority (FSCA). Any broker serving SA retail clients must be an authorised Financial Services Provider (FSP) under the FAIS Act; brokers acting as counterparty/market-maker issuing CFDs must additionally hold an OTC Derivative Provider (ODP) authorisation under the Financial Markets Act (in force since 2018), carrying capital-adequacy and trade-reporting duties. Verify any broker on the free FSCA FSP register (https://www2.fsca.co.za/Fais/Search_FSP.htm) and confirm the FSP number matches the broker's site.
What the cap actually is
No ESMA-style retail leverage cap in SA; brokers offer high leverage, offshore entities higher (verify per broker)
Measured across the base
How many of these firms are licensed here
Of the 104 brokers we measure for South Africa, 56 hold a local licence and the rest onboard residents through a foreign entity. That is not the same as being unregulated — it is a different question, and the broker pages name the entity in each case.
15 of them carry a warning from a regulator somewhere. A warning does not change a computed score here, but it removes the firm from beginner selections.
Warnings and where to read them
The FSCA publishes public warnings against unauthorised/impostor firms via its Media Releases (an updated list was issued around June 2025, with further late-2025 alerts on fake social-media groups and broker impersonation). Volatile - always cite the list 'as of [date]' and verify the current list at https://www.fsca.co.za (Media Releases).
